“Border Patrol (BP) and OAM should be combined within CBP.”

Border Patrol and the Office of Air and Marine remain separate CBP operational offices. Public Law 119-21 and Public Law 119-98 both fund Air and Marine agents as a distinct category alongside Border Patrol agents, and the FY2026 DHS appropriation forbids DHS from spending its money on section 872 reorganizations without new authorization — the route such a merger would take.

Research notes
Instrument sought: a CBP reorganization merging the Border Patrol and the Office of Air and Marine.
Searched 2026-08-28: presidential documents, final rules, proposed rules and notices in the Federal Register from DHS and its components; bills in Congress and public laws, from congress.gov; White House presidential actions; and federal court dockets (CourtListener), including a bulk snapshot of 1.2 million dockets. No reorganization notice was found, and section 513 of Public Law 119-86 now bars DHS from using its section 872 reorganization authority without new legislation.
