Fully implement the ICTS executive order authorities
Printed page 687 21. Department of Commerce
“Utilize new tools to eliminate threats to national security. Fully implement the Trump Administration’s Information and Communications Technology and Services (ICTS) Executive Order authorities in a way that ensures long-term success and the legal viability of this new national security tool.”
What has happened
- Partially done
Continued again for a second year. The authority has been preserved and the existing ICTS rules operate, but 'fully implement' has not happened: BIS issued no new ICTS rule, prohibition or determination in the window — the Bureau's whole active Unified Agenda contains no ICTS rulemaking — and the drones and connected-software proceedings begun before the window produced nothing further.
- Partially done
The President continued the national emergency declared by Executive Order 13873, which is the authority the whole Information and Communications Technology and Services regime rests on, keeping the ICTS rules and the connected-vehicles prohibition in force for another year.

Research notes
partial on §3’s “a mechanism in place” test: the ICTS authority is in force and its existing rules operate, which is a piece of the ask; the Quote’s operative word is “fully implement”, and the record shows the regime maintained rather than extended.
Negative search: Federal Register full text since 2025-01-20 for "information and communications technology and services" (12 documents — the two continuations, the 2026 and Spring 2025 Unified
Agendas, and eight FCC and other-agency rules using the phrase) and for "13873" (17 documents, same
picture); a jq pass over all 154 in-window BIS records, which contains no ICTS rule; and the DOC/BIS
Unified Agenda slice, seventeen RINs, none of them ICTS.
The connected-vehicles final rule that implements EO 13873 published on 2025-01-16, four days before the evidence window opens, so it cannot be cited as Evidence here even though its compliance dates fall inside the window; it is noted for the record and is why the continuations, not the rule, carry the events.
