The guidance went to every U.S. Attorney. The sanctuary memorandum directs all litigating components and each U.S. Attorney's Office to investigate obstruction of federal immigration enforcement and, where the evidence supports it, to prosecute violations of 18 U.S.C. 371 and 8 U.S.C. 1324 and 1373, and requires every declination on such a matter to be reported up under Justice Manual 1-13.130 — an accountability device the department applies to few subjects. The same day's charging policy requires the most serious readily provable offense across the board. Immigration and immigration-related offenses are emphasized to the U.S. Attorneys by binding memorandum with a reporting requirement attached.
