“Asylum Cooperative Agreements. While the agreements themselves must be negotiated, Congress should mandate that the executive branch work faithfully to negotiate and execute ACAs and set parameters to ensure that an unwilling executive cannot renege on an existing agreement or abandon the effort.”

EO 14165 section 8 directs the Secretary of State, with the Attorney General and the Secretary of Homeland Security, to "facilitate additional international cooperation and agreements", expressly including agreements under INA section 208(a)(2)(A) — the safe-third-country provision that Asylum Cooperative Agreements rest on. The executive is negotiating; Congress has neither mandated that it do so nor set the parameters that would stop a future administration abandoning the effort, which is the whole point of this Quote.
