Congress moved the other way: S. 5038, the "Special Education Administration Protection Act", was introduced on 2026-07-21 and referred to the Senate HELP Committee, as was S. 5046, which would prohibit transferring ED offices and functions to other agencies — reported to the Senate calendar on 2026-08-04.
- Attempted
ED and HHS signed an interagency agreement deepening HHS's role in special education and rehabilitative services — an executive workaround for an ask the Mandate directs at "federal lawmakers". Nothing has moved: the Office of Special Education and Rehabilitative Services remains in ED, ED keeps IDEA's statutory authority, and the fact sheet says the partnership "does not alter" the federal duty to enforce IDEA. Congress has not acted.
