Move the Office for Civil Rights to DOJ, enforcing only via litigation

“OCR should move to the Department of Justice. The federal government has an essential responsibility to enforce civil rights protections, but Washington should do so through the Department of Justice and federal courts. The OCR at DOJ should be able to enforce only through litigation.”
What has happened

ED and DOJ signed a Civil Rights Partnership under the Economy Act, pooling the two agencies' capacity for evaluating, investigating and resolving complaints — an executive workaround for an ask aimed at Congress. It is not the move the Mandate asks for: ED says it "will retain all statutory authorities and functions", the fact sheet tells complainants that the partnership "will not impact" them and that complaints are still filed with ED-OCR, and it describes the arrangement as building on a coordination agreement the two agencies have had for twenty years. Administrative enforcement — resolution agreements rather than litigation — continued (ED announced a Topeka Public Schools resolution agreement on 2026-08-25).

- Two further ED-DOJ agreements signed the same day — on student privacy protection and on training and advisory services — likewise leave ED’s authorities in place.
- OCR was cut hard in the March 2025 reduction in force (#803), which reduced the Department’s workforce by roughly half. Reporting that seven of twelve OCR regional offices closed could not be confirmed on an allowlisted source and is not recorded as Evidence.
- Congress has not moved OCR. S. 5046 would prohibit transferring ED offices and functions to other agencies and was reported to the Senate calendar on 2026-08-04 (https://www.govinfo.gov/content/pkg/BILLS-119s5046rs/html/BILLS-119s5046rs.htm).
