Prohibit CDC guidance from taking on a prescriptive character

   No statute and no regulation limits the character of CDC guidance. No bill in the 119th Congress addresses CDC's guidance authority, and the Federal Register carries no CDC rulemaking at all in the window - CDC published zero rules and zero proposed rules between 2025-01-20 and 2026-08-28. HHS moved in the opposite direction on process generally, rescinding the Richardson Waiver on 2025-03-03 so that grant, benefit and contract policy need not go through notice and comment. The negative now reaches CDC's own announcements as well as the Federal Register: CDC's complete newsroom for the window was enumerated through the agency's search index on 2026-09-03 (1,993 records, 176 dated on or after 2025-01-20) and no release announces any change to the character or bindingness of CDC guidance. Two in-window releases go the other way in substance — CDC acting on a Presidential Memorandum to update the childhood immunization schedule (2026-01-05) and adopting individual-based decision-making for hepatitis B immunization (2025-12-16) — but both are CDC changing what it recommends, not how prescriptively it recommends it.
