“Review EPA’s Environmental Justice and Title VI authority. … As a threshold matter, there is an opportunity to redefine EJ as a tool for the agency to prioritize environmental protection efforts and assistance to communities in proximity to pollution or with the greatest need for additional protection. Allocations of agency resources, increased EPA enforcement, and/or agency distribution of grants should be based on neutral constitutional principles.”

Executive Order 14281 directed all agencies to stop enforcing disparate-impact liability, including under Title VI regulations — the government-wide instruction that removes the disparate-impact theory EPA's Title VI complaints relied on; "neutral constitutional principles" is the order's own framing. EPA's external civil rights page (updated 2026-08-11) now shows only a Louisiana injunction and language-access review; no EPA Title VI rule change was found.

EPA announced the termination of its environmental-justice and DEI programs, describing EJ spending as diverted from direct remediation; no redefinition of EJ or Title VI policy was issued.

Federal Register API search for EPA “Title VI” documents since 2025-01-20 finds no EPA nondiscrimination-regulation rescission, unlike a dozen other agencies in June–August 2026; EPA’s 40 CFR part 7 may follow.
