CEQ adopted the removal as a final rule. Its September 2025 memorandum and template guide agency procedures; CEQ itself has no NEPA regulations to reinstate.

CEQ removed all of its NEPA regulations (40 CFR 1500–1508) by interim final rule rather than rewriting them along 2020 lines; the Biden-era rules are gone, but no CEQ rule restoring the 2020 provisions was issued. Agencies were told to write their own procedures.

- Boundary call: the Chapter 16 citation (“Rescind the Biden rules and reinstate the Trump rules”) is half met — rescinded, not reinstated. The Chapter 2 citation asks CEQ to rewrite its regulations restoring 2020 provisions such as the cumulative-impact ban; CEQ instead left the CFR empty and pushed the substance into agency-level procedures and guidance. Called partial; the consistency pass may prefer done on the reading that the 2020 provisions now live in agency procedures.
- The February 2025 CEQ guidance memorandum that accompanied the interim final rule moved from ceq.doe.gov to nepa.gov and was not located; the September 2025 memorandum on nepa.gov is used instead.
