Rescind Head Start COVID-19 vaccine and mask requirements

• The direct final rule was read in full at https://www.govinfo.gov/content/pkg/FR-2025-12-19/html/2025-23452.htm. Its Background recites each earlier step, including the two 2022 preliminary injunctions (Texas v. Becerra, N.D. Tex., 2021-12-31; Louisiana v. Becerra, W.D. La., 2022-01-01) and the 2023-03-31 vacatur.
• Leveling: settled on review 2026-09-01, Already-true flag kept. This item and #1324 are the two worked examples behind the amended Already-true rule, which strikes the “with nothing happening inside it” clause because of them. The Quote names two objects, the vaccine requirement and the mask requirement, and both were gone before 2025-01-20; the 2025-12-19 direct final rule removes the mitigation-policy residue, which is a third thing, and it goes in the note rather than defeating the flag.
• Prior reading, retained for the record: a reviewer who reads ‘the program’s COVID-19 vaccine and mask requirements’ as including the mitigation-policy requirement that replaced the mask rule would call this done at 2025-12-19 and drop the Already-true flag.
• The same rule is one of #1338’s Evidence items (eliminate Head Start); this item’s Quote is only about the COVID-19 requirements.
• HHS regulatory agenda, checked 2026-09-01. Checked against the full HHS agenda on reginfo.gov (183 active RINs in the 2026 Unified Agenda, published 2026-08-14), not the abbreviated version the Federal Register prints. The nearest entry is recorded here. It does not name this ask’s object, so the Status did not change: an agenda entry counts as an attempt only when it names what the ask asks for.
  • ACF’s two Head Start entries are 0970-AD21 (Restoring Flexibility to Support Head Start Program Access, NPRM published 2026-05-12) and 0970-AD30 (Modernize the Head Start Program by Reducing Requirements and Enhancing Alignment with State and Local Systems, NPRM 11/2026). Both cut cost and burden — staff wages and benefits, family child care provider qualifications, alignment with state systems — and neither mentions COVID-19 vaccination or masking, which this item’s note records as already gone before the window opened.
• Checked 2026-09-06, in a review of every Already-true flag: flag stands. Neither the Head Start vaccination requirement nor the masking requirement has been reinstated; the in-window direct final rule of 2025-12-19 removes the mitigation-policy residue at 45 CFR 1302.47(b)(9), which runs the same way as the ask. Pre-window truth extended - a change of degree - which the rule as amended on 2026-09-06 leaves flagged. ACF’s two open Head Start RINs (0970-AD21, 0970-AD30) reduce requirements further and neither mentions vaccination or masking.
