American Hospital Association injunction to bar HHS regulation or enforcement over denial of care to newborns with disabilities is on any allowlisted record. The HHS Guidance Repository was searched by title on 2026-09-03, each query against a verified control (a nonsense term returns a result table with zero rows, and every miss returns the same): `Bowen` → **0 rows**; `disabled infants` → **0**; `Baby Doe` → **0**; `liability immunity` → **0**; for contrast `newborn` → 1 (a 2009 CMS document on eligibility for newborns of Medicaid- and CHIP-enrolled mothers) and `PREP` → 10 rows on the first of five pages. The analysis does not appear on OGC's advisory-opinions index either. **How far this negative reaches** (playbook §3b): it covers HHS's **published guidance inventory**, which can show neither that the analysis stands nor that it was rescinded, and says nothing about internal OGC legal memoranda, which HHS does not publish. It is a negative resting on the absence of a document from an inventory, which is weaker than one resting on a document that says nothing, and it should be read as such.
