HRSA has restructured 340B, and not in the direction this ask names. Its 340B Rebate Model Pilot Program, announced in revised form on 2026-08-03 and effective immediately, changes *how* qualifying manufacturers effectuate the 340B ceiling price for a limited set of drugs — rebates paid after the fact instead of upfront discounts — while the discount itself continues to run to covered entities. "Beneficiary" appears three times in the twenty-page notice and never as a recipient of 340B savings; the two core statutory prohibitions the notice enforces, duplicate discounts and diversion, are both about covered entities. The notice records the scale of what was not redirected: 15,249 covered entities and 49,214 associated sites as of 2026-04-01, and $100 billion of purchases at 340B pricing in 2025. - Checked 2026-09-06 — the Pilot was opened, and two earlier statements were wrong. hrsa.gov can be read: https://www.hrsa.gov/opa carries the Pilot summary, dated “August 2026”. And the earlier note’s “no 340B rulemaking appears in the Federal Register in the window” was false as written — there are nine in-window HRSA 340B Rebate Model Pilot documents (a Federal Register search for “340B Rebate Model Pilot”, from 2025-08-01), all notices rather than rules. The distinction is real but the sentence read as a finding that nothing had happened, and something had.
