The dual-hat arrangement remains in place. Sec. 1508 of the FY2026 NDAA bars FY2026 funds from being used to reduce the Cyber Command commander's authorities as of 2025-06-01, and off-allowlist reporting says the administration shelved a split in 2025. Congress moved the other way: that provision fences FY2026 money against any diminution of the dual-hatted commander's authorities and oversight as they stood on 2025-06-01. Nothing directs a separation.

The FY2026 NDAA (P.L. 119-60, read): sec. 1508 prohibits FY2026 funds for reducing or diminishing the Commander of Cyber Command’s responsibilities or organizational oversight from those in effect 2025-06-01; secs. 1542 and the budget-control provisions expand CYBERCOM’s own budget authority. Nothing directs a separation. The FY2023 NDAA sec. 1533 (10 U.S.C. 167b note) conditions on ending the dual hat are the “congressional direction” the Mandate cites; no certification under them was found.
