Bar federal-jurisdiction schools from using non-birth-certificate names

What has happened

1. May 20, 2026 Attempted

   The House passed H.R. 2616, 217-198, which conditions Elementary and Secondary Education Act funds on a school obtaining parental consent before changing a student's “gender markers, pronouns, or preferred name on any school form”. That is one chamber, which is the `attempted` rung. It is narrower than the ask in three ways worth recording: it reaches records rather than how staff address a child, it covers only elementary and middle grades, and it fixes on the name on the school's own forms rather than on the birth certificate. The Senate referred it to the Committee on Health, Education, Labor, and Pensions on 2026-05-21 and has not acted. The Department is enforcing the records half administratively in the meantime, opening FERPA proceedings against Anne Arundel County and Ann Arbor on 2026-07-27.

   The Department's Student Privacy Policy Office told every federally funded school that FERPA and the PPRA entitle parents to inspect every record about their child, “Gender Plans” included, and asked state agencies to certify compliance by 2025-04-30. That is a right of access after the fact, not the written parental permission the Quote makes a precondition, so the rung does not move.
