Printed page 537 16. Department of the Interior
“End federal mandates and subsidies of electric vehicles.”
What has happened
- Done
EPA's final rule rescinded the 2009 greenhouse-gas endangerment finding and repealed all federal motor-vehicle GHG emission standards (effective 2026-04-20), ending the federal regulatory driver for EV sales; NHTSA had reset CAFE enforcement in June 2025 and proposed lower standards in December 2025. Petitions for review are pending in the D.C. Circuit; no stay found.

- NHTSA rule: Resetting the Corporate Average Fuel Economy Program
- NHTSA proposed rule: The Safer Affordable Fuel-Efficient (SAFE) Vehicles Rule III for Model Years 2022 to 2031
- Partially done
Public Law 119-21 §§70501–70504 terminated the new and used clean-vehicle credits (IRC §§30D and 25E) for vehicles acquired after September 30, 2025, the commercial clean-vehicle credit and the alternative-fuel refueling property credit — the main federal EV subsidies.
- Partially done
Congress used the Congressional Review Act to void EPA's waivers for California's Advanced Clean Cars II (the 2035 zero-emission sales rule), Advanced Clean Trucks and Omnibus Low-NOx standards — Public Laws 119-15, 119-16 and 119-17 — removing the state-level EV sales mandate that a dozen states had adopted.
- Public Law 119-16 — Congressional disapproval of EPA's waiver for California's Advanced Clean Cars II standards
- Public Law 119-15 — Congressional disapproval of EPA's waiver for California's Advanced Clean Trucks and related heavy-duty standards
- Public Law 119-17 — Congressional disapproval of EPA's waiver for California's Omnibus Low-NOx regulation
- Attempted
Executive Order 14154 §2(e) declared the policy of 'eliminating the electric vehicle (EV) mandate', ordered agencies to end regulatory preferences for EVs, and paused disbursement of IIJA/IRA EV-charging funds; no mandate or subsidy had yet been repealed.

Research notes
- Litigation over the endangerment-finding rescission (petitions filed in the D.C. Circuit from 2026-02-18 by environmental groups and on 2026-03-19 by 25 states) is described on Earthjustice and law-firm pages (off the allowlist). Briefing was under way in August 2026; no stay of the rule was found. If the court vacates or stays it, the Status would move to blocked or reversed.
- The CRA resolutions themselves are challenged by California (State of California v. United States is not among the federal court dockets we keep and search, from CourtListener; not searched further). Leads only.
- The SAFE III CAFE final rule was not found among the federal records we keep and search as of 2026-08-26.
