“In the event that the FEC fails to act, the President should direct the attorney general to prepare a guidance document from the Department of Justice for the public that outlines all of the FECA statutory provisions and FEC regulations that have been changed, amended, or voided by specific court decisions.”

The condition is satisfied — the FEC has issued no such guidance (#2226) — and the fallback was not taken up. No presidential direction to the Attorney General was found, and the Department has published no guidance document on FECA provisions voided by courts. Its public election-offence guidance is still the Public Integrity Section monograph Federal Prosecution of Election Offenses, 8th edition, which predates the window; the Election Crimes Branch page promises a Pocket Part "when available" and none is posted.
