“Although the CRCL Officer and the Freedom of Information Act (FOIA) Officer/Privacy Officer are statutory, their offices are not mandatory. CRCL and PRIV Officers and employees should report to a Deputy General Counsel, who would be a political appointee.”

The CRCL Officer and the Chief Privacy Officer still head offices of their own on the 2026-05-19 DHS organizational chart; no delegation, directive or announcement subordinates them or their staff to a political Deputy General Counsel. DHS did install a political appointee as Chief Privacy Officer in March 2025, but that is a different thing from moving the office under OGC.
