Congress did not make DOE non-nuclear programs the first source of additional resources for NNSA. P.L. 119-74 funds the non-nuclear accounts in full — Science $8.4bn, EERE $3.1bn, Nuclear Energy $1.785bn, Fossil Energy $720m, ARPA-E $350m — and funds NNSA separately; the only transfers in section 311 move IIJA balances into Nuclear Energy and the Grid Deployment Office, not into NNSA. No divestment of non-nuclear activities from the NNSA laboratories was found either.
