Make the Department of Defense a co-chair of CFIUS

Printed page 704 22. Department of the Treasury

“Congress should make the Department of Defense (DOD) a CFIUS co-chair with the Department of Treasury. Making DOD an official CFIUS co-chair along with Treasury will establish a balanced committee process by elevating national security interests to an equal stature.”

What has happened

  1. Not started

The Department of Defense was not made a co-chair of CFIUS. Section 721(k) of the Defense Production Act still names the Secretary of the Treasury as the sole chairperson, no bill in the 119th Congress would change that, and the administration has not asked for it — the America First Investment Policy memorandum assigns implementation to the Secretary of the Treasury "in coordination with the members thereof" and leaves the chairmanship where it is.

Research notes

Two CFIUS structure bills exist and neither touches the chairmanship: S. 2116 (annual review of national-security-sensitive federal facilities for real estate transactions, referred 2025-06-18) and S. 4748 / H.R. 9284, the Foreign Investment Review Monitoring and Commitment Tracking Oversight Board Act (referred 2026-06-11) — the latter would create a monitoring board, which is closer to #1975 than to this ask, and is in committee.

Shares the cluster negative search on CFIUS legislation with #1978.
