“CFIUS should publish a penalty schedule for violations of CFIUS reporting and mitigation requirements. Publishing a penalty schedule for CFIUS violations will reduce the discretion of the committee to waive penalties or impose mere “wrist slap” costs on violators of the law.”

No CFIUS penalty schedule was published. CFIUS's public enforcement material is still the Enforcement and Penalty Guidelines issued in October 2022, which describe aggravating and mitigating factors and leave the amount to the Committee's discretion — the discretion the Quote wants removed. A Federal Register full-text search for the quoted phrase "penalty schedule" since 2025-01-20 returns eight documents, none from the Treasury Department or about CFIUS, and Treasury's 2026 CFIUS work — the Known Investor Program request for information and the redesigned CFIUS website of 2026-07-29 — is about streamlining review, not about penalties.
