CMS has proposed no rule interpreting the Medicaid statute to disqualify elective abortion providers. No such rulemaking appears in the Federal Register in the window, and CMS's **45** active entries on the 2026 Unified Agenda - read in full on 2026-09-01 from reginfo.gov's HHS agency rule list (agencyCd=0900, 183 active RINs), not from the abbreviated version the Federal Register prints - include nothing on provider qualification or on abortion. The nearest are the two Medicaid integrity rulemakings, RIN 0938-AV70 (CMS-2450, managed care, financing and access, NPRM 07/2026) and RIN 0938-AW06 (CMS-2412, section 1115 demonstration budget neutrality, NPRM 01/2027), neither of which reaches who may be a Medicaid provider; "abortion" appears once in the whole HHS agenda, in ACF's RIN 0970-AD34 on unaccompanied children and the Hyde Amendment. The defunding was achieved without the rule: Public Law 119-21 section 71113 barred federal Medicaid payments to prohibited entities for one year, and Medina v. - A correction, made 2026-09-01. The Status does not change, but an earlier note’s arithmetic did: it said the 2026 Unified Agenda carried “six CMS entries”, which is the count in the abbreviated agenda the Federal Register prints — only entries needing a Regulatory Flexibility analysis are printed there. The full agenda on reginfo.gov carries 45 active CMS RINs, and every one was read by title on 2026-09-01. The finding survives the correction: none is a provider-qualification or abortion rulemaking. The negative now says what it actually covers.
