“Ensure senior policy and decision-making positions are always held by political appointees.”

What has happened

Nothing found, and the bureau's own roster shows the record sitting the other way. Enforcement and Compliance's senior policy posts below the Assistant Secretary are career Senior Executive Service positions; nothing in the window converts them to political appointments or records a policy that they be held by appointees, and OPM's annual list of career-reserved SES positions (2025-05-20) still carries Commerce entries. ITA's own senior-staff page, read on 2026-09-06, shows every one of E&C's four senior posts held in an acting or duties-performing capacity nineteen months into the term: Christopher Abbott "performing the non-exclusive functions and duties of the Assistant Secretary for Enforcement & Compliance", Victoria Flynn "Acting Deputy Assistant Secretary for Enforcement and Compliance", Scot Fullerton "Acting Deputy Assistant Secretary for AD/CVD Operations", Steven Presing "Acting Deputy Assistant Secretary for Policy & Negotiations". Elsewhere in ITA the same page shows appointed, non-acting deputy assistant secretaries in Global Markets and in Industry and Analysis — so this is a fact about E&C, not about ITA's page conventions.

What was searched, and what didn’t count as evidence

Research notes

Cluster negative search E&C-1 (chapter log): Federal Register full text since 2025-01-20 for "self-initiation" (1 hit, a 2025-03-31 correction notice), "surrogate country" (73 hits, all individual AD/CVD case notices), "non-market economy" methodology (131, same), "Top Markets" (0); plus a jq pass over every in-window Federal Register record whose agency is the International Trade Administration, with the individual AD/CVD case notices filtered out. Also grep -i 'Enforcement and Compliance' nominations.ndjson (0 — the unit has no Senate-confirmed post of its own below the Assistant Secretary for Enforcement and Compliance); the roster in src/data/people.json (no Current office matches); and Federal Register full text for "career reserved" Commerce, which returns OPM’s 2025-05-20 annual notice.

A conversion of career-reserved SES positions to general positions would appear in OPM’s next annual notice; the FY2026 notice covering calendar year 2025 has not published a Commerce change.
