Strengthen Executive Order 13132 on federalism

Not started

Printed page 49 2. Executive Office of the President

“Executive Order 13132 on federalism should be strengthened so that state regulatory and fiscal operations are not commandeered by the federal government through so-called cooperative federalism programs.”

What has happened

  1. Not started

EO 13132 has not been strengthened; the one instrument that touches it loosens it. OIRA's M-25-36 groups federalism alongside tribal consultation and takings as "Executive Orders That Impose Extensive Regulatory Processes on Agencies", and tells agencies to treat deregulatory actions as "presumptively not triggering these consultation or substantive analytic requirements" — and, where consultation is warranted, to fold it into ordinary notice-and-comment. Nothing in the window amends EO 13132, and nothing addresses the commandeering of state regulatory and fiscal operations through cooperative federalism that the Quote names.

What was searched, and what didn’t count as evidence

Research notes

Recorded as action that moves the other way: the Status stays not started and the contrary Primary evidence is attached to that event. Searched the presidential documents in the federal records we keep and search for “13132” and “federalism” (no hits — those records carry no abstract, so titles only) and read EO 14192, EO 14215, EO 14219, EO 14267, EO 14270, EO 14294 and EO 14332 in full at govinfo; only M-25-36 mentions EO 13132.
