Tax capital gains and qualified dividends at 15 percent
Printed page 696 22. Department of the Treasury
“Capital gains and qualified dividends should be taxed at 15 percent. Thus, the combined corporate income tax combined with the capital gains or qualified dividends tax rate would be roughly equal to the top individual income tax rate.”
What has happened

Public Law 119-21 rewrote individual and business taxation and left the preferential rate schedule alone: section 1(h) is not amended anywhere in the enrolled text, so long-term capital gains and qualified dividends are still taxed at 0/15/20 percent with the 3.8 percent net investment income tax on top, a 23.8 percent top rate. Searched the enrolled text for "section 1(h)", "capital gain rate" and "qualified dividend" — no amendment. No bill setting a flat 15 percent rate has passed either chamber.

Research notes
The one vehicle that could have carried this ask — the 2025 reconciliation act, Public Law 119-21 — made the seven-bracket ordinary rate schedule permanent (sec. 70101) and did not touch the capital gains and dividend rate schedule in section 1(h).
