The executive branch routed around the missing statute for grants but not for Title IV. Executive Order 14282 §3 directs agencies to make certification of Section 117 compliance "material for purposes of 31 U.S.C. 3729 and for receipt of appropriate Federal grant funds, which shall not be provided in cases of noncompliance". That reaches discretionary grants and the False Claims Act; the Quote's named objects — Title IV and Title VI participation — still require the HEA amendment the Senate has not taken up.

The House passed the DETERRENT Act (H.R. 1048) 241-169. Its §5 adds a new HEA §487(a)(30) making compliance with sections 117 and 117A-117D a program participation agreement condition, with a non-compliant institution "ineligible to participate in the programs authorized by this title for a period of not less than 2 institutional fiscal years" — exactly the Title IV linkage the Quote asks for. The bill was received in the Senate on 2025-03-31 and referred to the Committee on Health, Education, Labor, and Pensions, where it has stayed. Passage by one chamber is `attempted` (playbook §3b).
