Create a more vigorous anti-fraud program within EOIR
Printed page 568 17. Department of Justice
“Pursue a more vigorous anti-fraud program within the EOIR.”
What has happened
- Not started
EOIR has announced no anti-fraud program. Searched the Federal Register Corpus for every EOIR rule and notice in the window — temporary immigration judges, Board size, Board appellate procedure, EOIR fees, contempt penalties, the Office of the Chief Administrative Hearing Officer — and the department's press output; none establishes or strengthens a fraud program. The nearest instruments are practitioner discipline through the Board's own decisions and a July 2026 proposed rule creating civil money penalties for contempt of an immigration judge's authority, neither of which is the anti-fraud program the Quote names.

Research notes
Negative search: one search covered the whole cluster of immigration asks on pp. 567–568 (#1570, #1571, #1572, #1573, #1574, #1576, #1577, #1578). It listed the Executive Office for Immigration Review’s whole Federal Register output for the window and the department’s press releases over it, and EOIR’s thirteen Unified Agenda entries from a 2026-09-01 review of reginfo.gov — the nearest, RIN 1125-AB02, being civil money penalties for contempt of an immigration judge’s authority, which is not an anti-fraud program.
Searched 2026-10-15. EOIR published a new Privacy Act system of records, Fraud and Abuse Prevention Program Records, JUSTICE/EOIR-006 (FR 2026-21062, notice), and a companion proposed rule exempting it (FR 2026-21063), both 2026-10-15. The notice says the Fraud Program’s records “were previously included within” JUSTICE/EOIR-001 (69 FR 16179, 2004). That system was narrowed on 2025-08-29 and “now only partially covers” them. So the program predates the window, and the notice re-houses its records. It does not make the program more vigorous: there are no new staff, mandate or referral duty. The Status stays not started. This was read from the notice’s summary in the federal records we keep and search; we have not opened the notice to check that its “purpose” section claims nothing new.
