“Because liberal states have now become sanctuaries for abortion tourism, HHS should use every available tool, including the cutting of funds, to ensure that every state reports exactly how many abortions take place within its borders, at what gestational age of the child, for what reason, the mother’s state of residence, and by what method.”

    Abortion reporting to CDC remains voluntary and several states still do not report. No HHS action in the window conditions any funding stream on a state reporting abortion counts, gestational age, reason, residence or method: full-text Federal Register searches for "Abortion Surveillance" and "abortion complication" return 0 documents, and no CDC or CMS rule or notice imposes such a condition. CDC now answers this in its own words. Its Abortion Surveillance system page, read 2026-09-03, asks and answers the question directly: "Are states and jurisdictions required to report their abortion data to CDC? **No**, states and jurisdictions voluntarily report aggregate data to CDC for inclusion in its annual Abortion Surveillance report … **There is no national requirement for data submission or reporting.**" The latest published report is still *Abortion Surveillance — United States, 2022* (613,383 abortions from 48 reporting areas); no 2023 or 2024 annual report has appeared, and both pages carry the date 2024-11-27, so neither has been touched since before the window. The page is a read-but-undatable source under §5, not Evidence.

  • The four p. 455 CDC asks (#1217, #1219, #1220, #1221) share one negative search. cdc.gov was earlier recorded as refusing to open; it can be read, and the pages were read on 2026-09-03. None of them can be Evidence: the two Abortion Surveillance pages carry the date 2024-11-27 and the one fertility-awareness page 2024-11-19, all before the evidence window, so they fail the date test. They were read but cannot date anything in the window, and the fact that they have not been revised since before 2025-01-20 is itself the shape of the negative — nothing was added to CDC’s abortion surveillance in the window, and nothing was removed either.
