Cut the de minimis threshold from 25 percent to 10 percent
Printed page 673 21. Department of Commerce
“Reducing the de minimis threshold from 25 percent to 10 percent—or 0 percent for critical technologies;”
What has happened
- Not started
Nothing found. The de minimis threshold in 15 CFR 734.4 is unchanged at 25 per cent (10 per cent for certain destinations); no BIS rule in the window proposes cutting it to 10 per cent or to zero for critical technologies.
No action found yet. This entry is the starting point, not a finding.

Research notes
Cluster negative search BIS-1 (chapter log): a jq pass over all 154 in-window Federal Register records whose agency is the Industry and Security Bureau — every Entity List, Unverified List, Denied Persons, Section 232 and licensing document of the window — plus quoted-phrase Federal Register full-text searches since 2025-01-20, plus the Bureau’s whole active Unified Agenda on reginfo.gov (agencyCd 0600, DOC/BIS: seventeen RINs, each opened and read). "de minimis" Export Administration Regulations returns 486 in-window documents, almost
all AD/CVD case notices using the phrase in its trade-remedy sense; the BIS ones were read and none
amends part 734. Also searched: "de minimis" 734.4 and "25 percent" "de minimis".
Note the unrelated de minimis story that dominates the search results — the $800 low-value-shipment exemption under 19 U.S.C. 1321, ended for China in 2025 and globally by proclamation on 2025-08-29. That is a customs threshold at CBP, not the EAR’s foreign-content threshold, and is leveled in Chapter 26.
Reginfo agenda sweep, 2026-09-01 (§3b). The seventeen active RINs of the DOC/BIS slice of the 2026 Unified Agenda (agencyCd=0600, pubId=202510, published in the Federal Register 2026-08-14) were re-read against the rule settled 2026-09-01 — a dated agenda entry naming the ask’s object is attempted. “De minimis” appears in no entry title or abstract. Three entries cite 15 CFR part 734, where the de minimis rules sit at § 734.4 — RIN 0694-AJ43, RIN 0694-AJ74 and RIN 0694-AK11 — and none names the threshold. RIN 0694-AJ74 is the entry that moved #1857 to attempted, and its object is the foreign direct product rules; under §3b it does not answer this ask, which names a different object. Subject area only — Status unchanged.
