Tighten deemed export rules for foreign nationals

Research notes

The "deemed export" phrase search returning count 0 across all document types since 2025-01-20 is the load-bearing negative here — a quoted phrase returning 0 is a usable negative search (source-apis.md, measured 2026-08-28).

Cluster negative search BIS-1 (chapter log): a jq pass over all 154 in-window Federal Register records whose agency is the Industry and Security Bureau — every Entity List, Unverified List, Denied Persons, Section 232 and licensing document of the window — plus quoted-phrase Federal Register full-text searches since 2025-01-20, plus the Bureau’s whole active Unified Agenda on reginfo.gov (agencyCd 0600, DOC/BIS: seventeen RINs, each opened and read). Also checked: "foreign national" restricted to the BIS slug, and BIS’s Technology Letter of Explanation information collection (FR 2026-06120, 2026-12731), which is the deemed-export licensing paperwork and was renewed unchanged.

Reginfo agenda sweep, 2026-09-01 (§3b). The seventeen active RINs of the DOC/BIS slice of the 2026 Unified Agenda (agencyCd=0600, pubId=202510, published in the Federal Register 2026-08-14) were re-read against the rule settled 2026-09-01 — a dated agenda entry naming the ask’s object is attempted. No entry names deemed exports or the release-to-foreign-nationals provisions at 15 CFR §§ 734.13(a)(2) and 734.20. The nearest is RIN 0694-AJ43 Revision of End-Use and End-User Based Export Controls, Including U.S. Persons Activities Controls (Final Rule Stage, interim final rule projected 07/2026), which cites parts 734 and 744 but controls U.S. persons’ support of military and intelligence end users. RIN 0694-AJ74 moved #1857 and does not reach this ask. Subject area only — Status unchanged.
