Extend AGOA beyond 2025 with governance conditions
Printed page 276 9. Agency for International Development
“The next Administration should extend AGOA beyond its 2025 term but within a strategic framework that rewards good governance and pro–free market economic policies.”
What has happened
- Partially done
Extended again, for longer, and still without conditions. Section 2008 of the Continuing Appropriations and Extensions Act, 2027 (Public Law 119-103) strikes "2026" and inserts "2028" in section 506B of the Trade Act of 1974 and section 112(g) of AGOA, and carries the regional apparel and third-country fabric provisions to 2028-12-31. The eligibility criteria are untouched and USTR's modernization review has produced no bill. Partial: the ask's first limb, extension, now reaches 2028; the governance-and-markets framework does not exist.
- Partially done
USTR requested public comment on the "modernization" of AGOA — the first administration step toward a rewritten framework, with nothing enacted.
- Partially done
AGOA lapsed on 2025-09-30. Section 5019 of the Consolidated Appropriations Act, 2026 (Public Law 119-75) extended it — and the third-country-fabric and regional apparel provisions — to 2026-12-31, retroactive to the lapse, with no change to the eligibility criteria: an extension, but a short one and without the governance-and-markets framework the Mandate asked for.

Research notes
- Section 5019 text read at https://www.govinfo.gov/content/pkg/PLAW-119publ75/html/PLAW-119publ75.htm (amends 19 U.S.C. 2466b and 3721(g), (b)(3)(A), (c)(1), striking “September 30, 2025” and inserting “December 31, 2026”, with retroactive application to entries after the lapse).
- S. 2958 “AGOA Extension and Bilateral Engagement Act of 2025” (introduced 2025-09-30, referred to Senate Finance; congress.gov bill record) is the longer-term bill; no further action is recorded.
- USTR’s annual eligibility-review notices (2025-05-30 for CY2026, 2026-06-30 for CY2027; in the federal records we keep and search) show the existing eligibility process continuing unchanged.
- The next decision point was 2026-12-31; P.L. 119-103 §2008 moved it to 2028-12-31 (read in the enrolled bill on 2026-09-06; govinfo’s PLAW text was not yet posted). A rewritten AGOA would be the next event.
