Mandate E-Verify for anyone doing business with the government
Printed page 151 5. Department of Homeland Security
“Mandate the use of E-Verify for anyone doing business with the government.”
What has happened
- Not started
No action inside the window extends E-Verify to everyone doing business with the government. Federal contractors above the FAR thresholds have been required to use E-Verify since 2009 under Executive Order 12989 as amended and FAR subpart 22.18, which predates the evidence window and leaves out commercially available off-the-shelf items, contracts below the simplified acquisition threshold, subcontracts below $3,000 and work performed entirely abroad - the gaps the Quote's "anyone" would close. Federal Register full-text search for "E-Verify" over the whole window returns 19 documents, none of them a Federal Acquisition Regulation or grants rule touching the requirement.
No action found yet. This entry is the starting point, not a finding.

Research notes
Not flagged Already true. The pre-window FAR rule covers most federal contractors, not “anyone doing business with the government”: grant recipients, small purchases, COTS suppliers and overseas performance are outside it, and nothing in the window brings them in. The flag means this specific ask was already satisfied, and it was not.
One negative search covered this ask with the others on pages 151–158 of Chapter 5. The nineteen E-Verify documents in the window are USCIS information-collection notices for the E-Verify, E-Verify+ and myE-Verify programs, two DOJ Immigrant and Employee Rights charge-form notices, and unrelated rules; the OMB “Regulation for Federal Financial Assistance” proposal (2026-05-29) matched the search but contains no E-Verify requirement in its text.
Overlap: #336 (p. 137) asks Congress to permanently authorize and mandate E-Verify for all employers and is not started; bills exist (H.R. 251, H.R. 2641, S. 4620) and none has passed a chamber.
- Unified Agenda sweep, 2026-09-01. Two agencies’ full listings in the 2026 Unified Agenda were read at reginfo.gov: DHS (59 RINs) and the FAR Council (17 RINs). Neither carries an E-Verify entry. The two near misses: RIN 9000-AO89, FAR Case 2026-004, Revolutionary Federal Acquisition Regulation Overhaul parts 19, 22, 23 and 25, Proposed Rule Stage — part 22 is where the existing E-Verify contract clause lives, but the entry is an EO 14275 plain-language rewrite that never mentions employment eligibility verification; and RIN 1601-AB23, DHS’s companion to the government-wide Regulation for Federal Financial Assistance whose NPRM published 2026-05-29 (2026-10817) and which, as noted above, contains no E-Verify requirement. Nothing extends E-Verify beyond the pre-window FAR contractor rule. https://www.reginfo.gov/public/do/eAgendaViewRule?pubId=202510&RIN=9000-AO89
