“In addition, Congress should repeal subsidies for generation resources.”
What has happened
- Partially done
Executive Order 14315 directed Treasury to "strictly enforce the termination" of the §45Y/48E credits for wind and solar within 45 days and Interior to remove preferential treatment of wind and solar; Treasury's Notice 2025-42 (2025-08-15) tightened the beginning-of-construction test accordingly.

- IRS Notice 2025-42 — Beginning of Construction Requirements for Purposes of the Termination of Clean Electricity Production Credits and Clean Electricity Investment Credits for Applicable Wind and Solar Facilities
- Partially done
P.L. 119-21 §§70512-70513 end the clean electricity production and investment credits (IRC §§45Y and 48E) for wind and solar facilities placed in service after 2027-12-31 and add foreign-entity restrictions; the credits continue for nuclear, geothermal, hydropower and storage, and §70510 enlarged the zero-emission nuclear production credit. Subsidies were narrowed by technology, not repealed.

Research notes
- The Mandate’s sentence sits in the FERC section (p. 402) and is technology-neutral (“subsidies for generation resources”). The enacted change cuts wind and solar only and expands the nuclear credit; partial is the reading taken.
- Production-incentive rescissions proposed by DOE on 2025-05-16 (Renewable Energy Production Incentives, 2025-08569; cellulosic biofuel incentives, 2025-08572) are housekeeping removals of unfunded programs, not tracked as events.
