Stop USDA summer meals for students not in summer school

“Further, the USDA should not provide meals to students during the summer unless students are taking summer-school classes. Currently, students can get meals from schools even if they are not in summer school, which has, in effect, turned school meals into a federal catering program.”

USDA moved the other way: it made summer meals easier to deliver to children who are not in summer school. On 2025-06-06 FNS removed the Coordinated Services Plan requirement from the Summer Food Service Program and the Summer EBT program and from the rural non-congregate option — the option that exists precisely so children can be fed away from a school site; on 2025-06-11 it cleared obsolete state-option provisions out of the Summer EBT rules; and on 2026-04-22 it set the 2026 Summer EBT benefit levels, continuing the program. Nothing conditions a summer meal on summer-school enrolment, and USDA's 2026 Unified Agenda's two summer-program RINs (0584-AF24 non-congregate integrity, 0584-AF25 CACFP/SFSP fraud) are integrity rulemakings, not eligibility restrictions. - Congress ran the same way: H.R. 7567’s nutrition title has no summer-meal restriction, and the summer bills among those we keep and search (Summer Meals REACH Act, Summer Meals and Learning Act, H.R. 9265) would expand access. All are in committee.
- Summer EBT itself is a statutory program created by the Consolidated Appropriations Act, 2023, so ending non-summer-school meals would need Congress even though this item is not marked as needing an act of Congress; that is noted rather than acted on, because the Quote addresses USDA.
