Divert CIA resources away from 'social engineering' activities
Printed page 209 7. Intelligence Community
“As soon as possible, the Director should divert resources from any activities that promote unnecessary and distracting social engineering.”
What has happened
- Partially done
The Fourth Circuit's published opinion records the implementing action at the CIA and ODNI: officers assigned to DEIA duties were placed on paid administrative leave from 2025-01-22 under OPM's implementing memorandum, and about three weeks later nineteen career intelligence officers were notified of termination, the CIA Director stating that the terminations were taken to effectuate Executive Order 14151. The resources the Quote calls social engineering have been diverted at the Agency. `partial` rather than `done` because the ask is open-ended and because the court affirmed a preliminary injunction requiring the Agencies to follow their own termination procedures.
- Attempted
Executive Order 14151 directed every agency head, the CIA's included, to terminate to the maximum extent allowed by law all DEI and DEIA offices and positions, and Executive Order 14173 the following day directed all agencies to terminate discriminatory and illegal preferences, mandates, policies and programs. Directives, with nothing yet diverted.

- Full opinion read at https://www.govinfo.gov/content/pkg/USCOURTS-ca4-25-01527/pdf/USCOURTS-ca4-25-01527-1.pdf (48 pages, published, Berner J., Niemeyer J. dissenting). The district docket is https://www.courtlistener.com/docket/69646552/doe-1-v-office-of-the-director-of-national-intelligence/ (E.D. Va. 1:25-cv-00300, filed 2025-02-17) — a lead, since CourtListener docket pages 403.
- The injunction requires the CIA and ODNI to honor Agency Regulation 4-16 before terminating the officers. It does not restore the DEIA offices or reverse the diversion of resources, so the Status is not blocked.
- Congress moved the other way in the same window: section 6307 of the Intelligence Authorization Act for FY2026 (P.L. 119-60, Division F) is titled “Prohibiting discrimination in the intelligence community”. Context only; it restores no office.
