“In recent years, Congress has appropriated many billions of dollars in excess of EERE’s normal budget (DOE requested more than $4.0 billion for FY 2023). It should rescind these excess monies so that DOE is not required to spend them.”
What has happened

Congress rescinded some of the excess but not the base. P.L. 119-21 section 50402 repealed IRA section 50142 and rescinded the unobligated balances of eight further IRA sections including the home energy rebate and efficiency programs EERE administered, and P.L. 119-74 section 311(d)(5) repurposed $393,858,299 of amounts provided under the Energy Efficiency and Renewable Energy heading plus $1,281,141,701 and other IIJA balances. The annual appropriation survives at $3,100,000,000 for FY 2026.
